Summary of the Case:
The American Player Adreian Payne (208-F/C-91, college: Michigan St.) and his Agency Altius Culture Limited filed a claim against the Chinese Club Nanjing Tongxi Basketball Club for outstanding salaries, penalties, punitive damages and interest. The Claimants submitted that the Respondent's behaviour towards the Player, particularly related to his health and well-being, forced him to terminate the Contract for just cause. In its Answer, the Respondent argued that the Player was not entitled to terminate the Contract because it was merely taking reasonable medical action to provide full assistance to him in diagnosing and treating his medical conditions, and it provided him with all of the amenities provided in the Contract. In its Counterclaim, the Respondent argued that the Player terminated the Contract prematurely without just cause entitling it to damages as well as to outstanding fines owed by the Player. In its response to the Counterclaim, the Claimants argued that the Respondent was not entitled to damages as the Player had terminated the Contract with just cause and the fines were unjustified. Both the claim and the counterclaim were dismissed.
